2026 Public Charge Regulation

On July 16, 2026, the Department of Homeland Security (DHS) published a final public charge rule, effective September 18, 2026. According to Protecting Immigrant Families (PIF) and the National Immigration Law Center (NILC), the public charge inadmissibility test applies when a person applies for a green card or for a visa and many are exempt from public charge due to laws that cannot be changed by regulations.
“Neither the final rule nor the published guidance includes a comprehensive list of specific programs that can – or cannot – be considered in determining whether a noncitizen is likely to become a public charge.
